What is a Washington uncontested divorce?
The most commonly asked questions are what exactly is an uncontested and do I qualify to obtain one? Simply put, an uncontested divorce is a negotiated settlement that resolves and encompasses every outstanding legal issue in a dissolution proceeding.
If the Parties are unable to agree on the property division, a parenting plan, maintenance, or any other aspect of their divorce, then they are unable to proceed by way of an uncontested divorce.
In order to qualify for an uncontested divorce, you and your spouse must simply agree on all of the terms of the dissolution and one of you must have resided in Washington state for at least six months at the time of filing the Petition.
How long does an uncontested divorce take?
Our offices have simplified the uncontested divorce process as much as possible. Upon completion and return of our divorce questionnaire, we begin drafting the final documents. After reviewing the final orders, each party signs them.
At this point, the Petition is filed. Due to the statutory waiting period, the parties must then wait 90 days before the divorce can be finalized.
Do I need to appear in court?
No. In nearly all of our uncontested divorces, neither party is required to make a court appearance. Once the Parties have signed off on the final orders, our offices handle everything else.
